This page, along with the documents referred to on it, tells you the terms of use under which you can make use of John Brereton Jewellers Website.  Please read these terms of use carefully before you start to use the site. By using it, you indicate that you accept these terms of use and that you agree to abide by them.  It's up to a user of the website to check back regularly for updates to these terms and conditions.

Terms of Sale and Contract

By ordering with us you are offering to make a purchase based on these T&Cs. All orders are subject to availability and confirmation of the order price.  No contract for the sale of an item will exist unless John Brereton Jewellers has accepted the order and sent confirmation that it has been shipped.  Acceptance of this contract will be considered complete once the item has been dispatched and payment has been taken from the credit card used to place the order.  Only adults aged 18 and over are entitled to enter into a legally binding contract.

  

Products, Pricing and Cancellations

John Brereton Jewellers makes all reasonable efforts to represent products as accurately as possible through descriptions and imagery. Sometimes errors occur and we cannot be held responsible for this.  We also cannot guarantee that your monitor's display of product colour, texture, or detail will be accurate as all computer monitors are different. John Brereton Jewellers reserves the right to refuse or cancel a sale and refund any money accepted if any details about the item are inaccurate.  We will not be liable for any loss or cost suffered because of this.  

You can choose to place your order in a variety of currencies. We do our best to ensure that all website content is accurate and up to date but sometimes there might be errors in prices listed too.  We do not honour inaccurate prices.  If the price of your item is wrong we will contact you before shipping so that you have the option to pay the accurate price or cancel your order.  If the item has already been shipped, you agree to send it back or pay the difference between the error price and the correct one.  Prices may change at any time without notice and we do not negotiate on pricing.  We apologise for any inconvenience this may cause.  Please contact us at info@johnbreretonjewellers.ie if you have any questions. 

If you find you need to cancel your order please contact us as soon as possible after you have placed it.  It is possible to cancel your order if we have not yet processed it and shipped the item to your address.  You always have the option of returning it later but in this case you may incur return postage fees.

 

Conflict Diamonds 

John Brereton Jewellers only purchase diamonds through respected suppliers who adhere to the standards of the Kimberley Process. This is an international system that fights to ensure the diamond trade is free from sources of conflict.

 

Comparison Purchasing 

This process is not allowed which in turn allows us to keep our prices low. Comparison purchasing means buying several of one item such as a diamond and only keeping the preferred choice so that the rest can be returned.  The inventory overhead and restocking involved in this can be very costly.  Please do get in touch with us so that we can help you make the right choice the first time around.

  

Payment Methods

Payments on John Brereton Jewellers can be made with all major credit cards including Visa, Mastercard and Maestro. Payments under €15,000 will be accepted through Paypal.  Payments by bank wire is also possible.  Please contact us at info@johnbreretonjewellers.ie for these details.

  

Delivery and Insurance

Your order is deemed to be delivered when the items are delivered to your address, not to you personally.  All deliveries must be signed for on arrival as proof of receipt for insurance reasons.  This delivery insurance is an agreement between the customer and the insurance company.  Title of the items will pass to you on delivery if we have received full payment for them.  If your order is returned to us because the courier or postal service could not deliver it for whatever reason, you will be responsible for repeat delivery costs.  Any alternative shipping addresses provided for delivery must be on file with your credit card company to protect against fraud.  For more information on deliveries please see our Delivery & Returns Policy

 

Accessing the Website

Access to this website is permitted on a temporary basis.  John Brereton Jewellers reserve the right to withdraw or amend the service we provide on this website without notice.  From time to time we might restrict access to some parts or all of the website.  We will not be liable if, for any reason, our site is unavailable at any time or for any period.  We also cannot guarantee that our emails, the website, and the server that makes it available will always be free of bugs or viruses or that your needs will be served by them.  We can not be responsible or liable for any loss of content transferred through the website.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and not disclose it to a third party. We have the right to disable any user identification code or password,  whether chosen by you or allocated by us, at any time if in our opinion you have failed to comply with any of the provisions of these terms of use.

You are responsible for making all arrangements necessary for you to have access to our website.  You are also responsible for ensuring that all people who access our site through your internet connection are aware of these terms and that they comply with them.

You may use our site only for lawful purposes.  You may not use our site in the following ways:

You may share material from our website on social media sites (Facebook, Twitter etc.) subject to these terms.  Such use must be for personal use only, not for business purposes, or to suggest a connection between us and any third party.  It can not be used to promote other products or services and we reserve the right to have any material removed immediately on notice.  Our status (and that of any identified contributors) as the authors of material on our site should always be acknowledged.

Submissions

John Brereton Jewellers enjoy hearing from their customers and welcome comments and suggestions, so long as they are not illegal, threatening or injurious and do not contain spam or viruses.  You may not use a false email address or mislead us about the origins of such submissions.

You agree that any materials such as comments, questions, drawings, plans, notes etc. or any other information regarding this website provided by you are non-confidential and will become the sole property of John Brereton Jewellers.  John Brereton Jewellers will be entitled to unrestricted use of these materials for any purpose including commercial without acknowledgement or compensation to you.  You also grant John Brereton Jewellers the right to use the name under which this information is submitted.  You warrant that you own the rights to the content you submit, that it is accurate and not misleading, and that it will not violate any rights or cause injury to others.

Liability 

So far as permitted by law, and except in respect of death or personal injury arising from negligence, John Brereton Jewellers including its directors and staff will not be liable for any indirect, special, incidental or consequential damages of any kind arising from use of this website, its content, or its products and services.  This includes delays in operation or failures of performance resulting from any situation such as theft, communications failure, acts of god etc. John Brereton Jewellers cannot be held responsible for any delays in the postal system once your order has been dispatched. 

In the case of returns, we shall have no liability to you unless you notify us by email of the return within 28 days of you receiving the original dispatch email.

This is accepting jewellery that's found to be faulty and returned to us within or outside the 28 day period.  Our workshop will examine returned items carefully.

We expect not to find proof of interference with the jewellery when we examine it for a manufacturing problem, otherwise we cannot accept it back and will have to post it back to you. Should this occur you will be liable for the delivery costs.  If the jewellery is faulty due to a manufacturing issue you will be entitled to a repair, replacement, or refund.  We are not obliged to compensate you outside of a refund.  Please see our Delivery & Returns Policy for more information.

You must comply with all regulations and legislation, including attending to customs duties, import tax or other permits that you will you need to purchase goods from our site.  The use of our website, importation, or exportation of our products to you might be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the goods that you buy. 

None of the above affects your statutory rights.  

 

Governing Law 

These terms and conditions will be governed by and construed in accordance with Irish Law.  You and John Brereton Jewellers irrevocably submit to the non-exclusive jurisdiction of the Irish Courts.  If such court deem any provisions made by these T&Cs to be unenforceable, the remaining provisions here will nevertheless remain in full force and effect.

 

Dispute Resolution 

Disputes arising with respect to these T&Cs will be resolved by negotiation between the parties or, if necessary, by resort to an appropriate court located in Dublin, Ireland.  You agree to hold harmless and indemnify John Brereton Jewellers for any legal and accounting fees arising from your misuse of the website, from trying to secure payments owed by you or from your breach of these Terms of Use.

  

Our Site Changes Regularly

We aim to update our site regularly and may change the content at any time.  If the need arises, we may suspend access to our site or close it indefinitely.  Any of the material on our site may be out of date at any given time and we are under no obligation to update such material.  All prices are inclusive of VAT, where applicable, at the prevailing rate.

 

Our Right to Vary These Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time.
